Welcome to Moorina Haven Retreat.

These Terms & Conditions govern all direct bookings made with Moorina Haven Retreat. By making a reservation, each guest acknowledges that they have read, understood and agree to be bound by these Terms & Conditions, together with our Booking & Cancellation Policy, House Rules and all other property policies.

1. Eligibility to Book

To make a booking with Moorina Haven Retreat, the person making the reservation must:

• Be at least 18 years of age.
• Be authorised to make the booking on behalf of all guests included in the
  reservation.
• Provide accurate and complete booking information.

The person making the booking accepts responsibility for ensuring that all guests comply with these Terms & Conditions and the property’s policies.

As Moorina Haven Retreat is an adults-only retreat, all guests staying at the property must be 18 years of age or older.

2. Booking Confirmation

A booking is confirmed only once:

• The required payment has been received.
• Written confirmation has been provided by Moorina Haven Retreat.

We reserve the right to decline or cancel any booking where incorrect information has been provided or where these Terms & Conditions are breached.

3. Guest Responsibilities

Guests agree to:

• Comply with all House Rules and property policies.
• Respect neighbouring properties and maintain appropriate noise levels.
• Treat the accommodation, furnishings and facilities with reasonable care.
• Notify the hosts promptly of any accidental damage, maintenance issues or safety concerns.
• Use all amenities, including the spa, BBQ and fire pit, safely and responsibly.
• Leave the property in a reasonably clean and tidy condition upon departure.
• Comply with all applicable laws, regulations and emergency directions during their stay.

The person making the booking is responsible for the conduct of all guests included in the reservation.

4. Liability

While every reasonable effort is made to provide safe, comfortable and well-maintained accommodation, guests acknowledge that they use the property and its facilities at their own risk.

To the maximum extent permitted by law, Moorina Haven Retreat is not liable for:

• Personal injury or illness occurring during your stay, except where caused by our
  negligence or where liability cannot legally be excluded.
• Loss, theft or damage to personal belongings.
• Vehicle damage, theft or loss while parked on the property.
• Interruptions to services outside our reasonable control.

Guests are responsible for supervising their own safety while using the accommodation and outdoor areas.

5. Property Damage

Guests may be responsible for the reasonable costs associated with repairing damage, replacing missing items or undertaking additional cleaning where damage or loss results from negligence, misuse or a breach of these Terms & Conditions or the property’s policies.

Supporting documentation may be provided where applicable.

6. Force Majeure

Moorina Haven Retreat shall not be liable for any failure or delay in providing accommodation or services where such failure arises from circumstances beyond our
reasonable control.

These circumstances may include, but are not limited to:

• Bushfires
• Flooding
• Storms or severe weather
• Cyclones
• Power outages
• Water supply interruptions
• Government restrictions or emergency orders
• Natural disasters
• Public health emergencies
• Telecommunications failures
• Other unforeseen events beyond our reasonable control

Where possible, we will communicate with guests promptly and work in good faith to discuss alternative arrangements.

7. Emergency Situations

Guests agree to comply with any reasonable directions provided by emergency services or the hosts during emergencies, including evacuation instructions where required.

Guest safety will always remain our highest priority.

8. Privacy

Personal information collected during the booking process is managed in accordance with our Privacy Policy.

9. Changes to These Terms

Moorina Haven Retreat reserves the right to amend these Terms & Conditions from time to time.

The version applicable to your booking will be the version in effect at the time your reservation is confirmed.

10. Governing Law

These Terms & Conditions are governed by the laws of the State of Queensland, Australia.

Any disputes arising in connection with your booking or stay shall be subject to the
jurisdiction of the courts of Queensland.

11. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that guests may have under the Australian Consumer Law or any other applicable
legislation.

Where liability cannot legally be excluded, our liability is limited only to the extent permitted by law.
